Used when the signer is confirming that they signed the document voluntarily for the purposes stated in it (signature can often be made before appearing before the notary).

Common documents/forms:

•  Deeds, warranty deeds, quitclaim deeds

•  Mortgages, deeds of trust, real estate contracts

•  Powers of attorney (financial, medical, durable)

•  Trust documents and trust amendments

•  Bills of sale for vehicles or property

•  Contracts, agreements, and leases that need recording or formal execution

•  Corporate resolutions or business documents signed in a representative capacity

•  Most documents being recorded with a county clerk

Used when the signer must swear or affirm under penalty of perjury that the statements in the document are true (signer must sign in the notary’s presence + take an oath/affirmation).

•  Affidavits of any kind

•  Sworn statements or declarations

•  Depositions or court-related sworn filings

•  Applications requiring an oath (certain government, licensing, or insurance forms)

•  Financial statements or asset declarations under oath

•  Some IRS or tax-related forms that require a sworn statement

Used when the notary simply confirms that the identified person signed the document in their presence (no acknowledgment of willingness or oath about content).

Common documents/forms:

•  Certain contracts or agreements that only need a witnessed signature

•  Some wills or codicils (when state law allows a notary as witness)

•  Documents where the preprinted certificate specifically calls for “signed or attested before me”

Used when the notary compares an original document to a copy and certifies the copy is accurate and complete (original cannot be a vital record or publicly recordable document in many cases).

Common documents/forms:

•  Copies of diplomas, transcripts, contracts, or personal records

•  Copies of passports, IDs, or other non-public documents the signer possesses

•  Any non-vital, non-public record that needs a certified true copy

Used when there is no written document, or the oath is separate from a jurat.

Common situations:

•  Swearing in a witness for testimony

•  Verbal oaths required by an agency or proceeding without a signed record
