1. Acceptance of Terms
By accessing this website, requesting services, or scheduling an appointment with Rotary Notary LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Description of Services
Rotary Notary LLC provides mobile notary public services throughout the State of New Mexico. Services may include acknowledgments, jurats, oaths/affirmations, copy certifications, and related notarial acts performed by a commissioned New Mexico Notary Public (Charly Smith, Commission #2008824).
We travel to locations convenient to the client (homes, offices, hospitals, businesses, or other agreed sites) on a statewide basis, subject to availability and travel fees.
3. Notary Limitations
A notary public is a public officer authorized only to perform specific notarial acts.
• We do not provide legal advice, legal representation, or document preparation.
• We do not explain the legal effect of documents or advise whether you should sign.
• We cannot notarize incomplete documents or documents that appear incomplete or blank where required information is missing.
• We must refuse any request that would violate New Mexico notary law or our professional obligations.
4. Client Responsibilities
You agree to:
• Provide valid, acceptable identification as required by New Mexico law.
• Present complete, ready-to-sign documents.
• Be present (or ensure all required signers are present) at the scheduled time and location.
• Disclose any special circumstances in advance (multiple signers, hospital setting, language needs, etc.).
• Pay all agreed fees at the time of service unless other arrangements have been made in writing.
5. Fees and Payment
Notarial fees are subject to the maximums set by New Mexico law (currently $5 per most notarial acts). Travel, convenience, after-hours, and other non-notarial fees are additional and will be quoted and agreed upon before the appointment.
Payment is due at the time of service unless otherwise arranged. We accept cash, check, and major credit/debit cards (including contactless methods).
Fees are generally non-refundable once the notarial act has been performed.
6. Scheduling, Cancellation, and No-Shows
Appointments are confirmed only after we acknowledge your request.
Please provide as much notice as possible if you need to cancel or reschedule. Late cancellations or no-shows may result in a cancellation fee to cover travel time and opportunity cost. The specific fee (if any) will be disclosed when the appointment is booked.
7. Travel and Service Area
We serve the entire State of New Mexico and will travel as needed. Travel fees scale with distance and time and will be disclosed and agreed to in advance.
8. Limitation of Liability
To the fullest extent permitted by law:
• Rotary Notary LLC and Charly Smith shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website.
• Our total liability for any claim related to a notarial act shall not exceed the fees paid for that specific service or the limits of our Errors & Omissions insurance policy ($25,000 aggregate), whichever is less.
• We maintain a $10,000 surety bond as required by New Mexico law and $25,000 Errors & Omissions insurance (Policy #101810082, Merchants Bonding Company).
9. Privacy and Confidentiality
We treat all client information and documents as confidential. We maintain a notary journal as required by New Mexico law and retain records for the period required by statute (currently 10 years after the last entry). We do not sell or share your personal information except as required by law or necessary to complete the requested service.
10. Website Use
You may use this website for lawful purposes only. You may not attempt to disrupt the site, scrape content, or use it for any fraudulent purpose.
11. Intellectual Property
All content on this website (text, design, logos, etc.) is owned by Rotary Notary LLC and may not be copied or used without permission, except for personal, non-commercial reference.
12. Governing Law
These Terms are governed by the laws of the State of New Mexico. Any disputes shall be resolved in the courts of Bernalillo County, New Mexico, unless otherwise required by law.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this website with the effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
